Harold C. Schott Scholarship Award Lecture featuring Prof. Darrell Miller
Darrell A.H. Miller, Professor of Law at the University of Cincinnati College of Law, will present the lecture “The Second Amendment in Theory and Practice.” The talk will be a description of the history of Second Amendment doctrine pre-Heller and McDonald, a description of what Heller and McDonald actually resolved, and an identification of the issues that Heller and McDonald left unresolved, including the level of scrutiny for Second Amendment cases. This part will highlight the disconnect between the opinion itself and the traditional levels of scrutiny (strict scrutiny, intermediate scrutiny, rational basis). Miller’s lecture will educate audiences about what Heller and McDonald actually changed, explore how the Court’s statements in these cases create problems with respect to the test the lower courts are supposed to supply, discuss the proposed solutions that various lower courts and commentators, including myself, have offered, and comment more broadly about the role of common law devices in implementing constitutional rights.
